1. Acceptance
These Terms of Service ("Terms") govern your use of the Predator Locator mobile application and this website (together, the "Service"). By downloading, installing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The service
The Service displays information about registered sex offenders that is published by government agencies in publicly accessible registries. It plots registered addresses on a map, lists entries near a location, and shows the details each registry publishes for an entry.
The Service is an information and awareness tool. It does not provide legal advice, investigative services, or any form of screening or vetting.
3. Eligibility
You must be at least 17 years old to use the Service. By using it you confirm that you meet that requirement and that your use complies with the laws of your jurisdiction.
4. Registry data and accuracy
All registry information is sourced from public government registries and is presented substantially as we receive it. We do not create, verify, correct or independently confirm it.
- Records may be incomplete, outdated, duplicated or incorrect, including names, photographs, offense descriptions and addresses.
- A listing at an address does not mean the person currently lives there, and may reflect a former, approximate or administrative address.
- The absence of a listing does not mean that no registrant lives in an area or that an area is safe.
- Records are not updated in real time and may differ from what the official registry shows today.
Before you rely on anything you see in the Service, confirm it directly with the official state, county or federal registry.
If you believe a record about you is inaccurate, the authoritative source is the government agency that publishes it. Corrections must be made with that agency; once corrected at the source, the change flows into the Service. You may also raise it through the support channel on our App Store listing.
5. Permitted and prohibited use
Registry information is published so that the public can protect itself. It is a crime in every U.S. state to use it to harm a registrant or anyone associated with them. You agree that you will not use the Service, or any information obtained through it, to:
- harass, threaten, intimidate, stalk, defame, injure or discriminate against any person;
- damage property, or encourage, organise or assist anyone else in doing any of the above;
- make decisions about employment, housing, tenancy, education, credit, insurance, benefits or professional licensing;
- build, populate, publish or sell any list, database or product derived from the Service;
- scrape, crawl, mirror, reverse engineer, decompile or otherwise extract data from the Service in bulk or by automated means;
- circumvent any access control, paywall, rate limit or security measure;
- violate any applicable law, including the terms under which the source registry publishes its data.
We may suspend or terminate access immediately for any breach of this section, and may report unlawful conduct to law enforcement.
6. Not a background check
The Service is not a consumer reporting agency and the information it provides is not a consumer report as defined by the Fair Credit Reporting Act (15 U.S.C. ยง 1681 et seq.) or any comparable state law. Do not use the Service for any purpose requiring FCRA compliance, including tenant, employment, insurance or credit screening.
7. Subscriptions and payment
Parts of the Service are free. Others, including photographs, offense details and registered addresses, require a paid subscription purchased through the Apple App Store.
- Prices, billing periods and any free trial are shown in the app before you buy and are charged to your Apple Account.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period.
- You can manage or cancel a subscription in your Apple Account settings at any time. Cancelling stops future renewals; the current period continues until it expires.
- If a free trial is offered and you subscribe before it ends, the unused portion of the trial is forfeited.
- All purchases are processed by Apple. Refunds are handled by Apple under its policies, not by us.
Purchases made through the App Store are also subject to Apple's Licensed Application End User License Agreement. Where these Terms conflict with that agreement in respect of the licence to use the app, that agreement controls.
8. Intellectual property
The app, this website, and their design, code, text and graphics are protected by intellectual property law. You get a limited, non-exclusive, non-transferable, revocable licence to use the app for your own personal, non-commercial purposes. Underlying government registry records are public records and are not claimed as our property.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currency or non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any information in it is correct.
Nothing in the Service is a substitute for your own judgment or for contacting law enforcement. If you believe someone is in danger, contact your local emergency services.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill, or for personal injury or property damage, arising out of or relating to your use of the Service or your reliance on any information in it. Our total aggregate liability for all claims is limited to the greater of the amount you paid for the Service in the twelve months before the claim arose, or twenty five U.S. dollars.
Some jurisdictions do not allow certain exclusions or limitations, so parts of sections 9 and 10 may not apply to you. In that case those exclusions apply to the fullest extent the law allows.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising from your misuse of the Service or your breach of these Terms, in particular section 5.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for breach of these Terms. You may stop using the Service at any time by deleting the app. Sections 4, 5, 6, 9, 10 and 11 survive termination.
13. Changes to these terms
We may update these Terms. The revised version is posted at predatorlocator.com/terms with a new "last updated" date. Continued use of the Service after a change means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. You agree that any dispute will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of any protection you have under the mandatory law of your place of residence.
